Acceptance of Terms
By using this automated video publishing system (referred to as "the application"), you agree to these Terms of Service. This application is a private automation tool and is not offered as a public service. Access is restricted to authorized users only.
Description of Service
The application provides automated video content generation and publishing to social media platforms, specifically YouTube. The service includes script generation, text-to-speech audio production, stock media sourcing, video composition, and scheduled uploading to authorized channels.
Authorized Use
This application is intended solely for the personal use of Michael Fackerell to manage his own social media channels. The following activities are prohibited:
- Using the application to publish content to channels not owned or explicitly authorized by Michael Fackerell
- Distributing, selling, or sharing access to the application
- Using the application to upload content that violates the terms of service of any target platform (including YouTube Community Guidelines)
- Reverse engineering, modifying, or creating derivative works of the application
Content Responsibility
Michael Fackerell is solely responsible for all content published through the application. The application does not review, endorse, or take editorial control over published content. The operator must ensure that all published content complies with applicable laws and the terms of service of each target platform.
Intellectual Property
Stock media sourced through the Pexels API is used in accordance with the Pexels license, which permits free use for commercial and non-commercial purposes without attribution. AI-generated images produced through the Replicate API are subject to the Replicate terms of service. All other content created by the application is owned by Michael Fackerell.
Third-Party Services
The application relies on third-party APIs and services, including but not limited to YouTube Data API v3 (Google LLC), OpenAI API, Pexels API, and Replicate API. Use of these services is subject to their respective terms of service. The application is not responsible for changes, outages, or policy enforcement by third-party providers.
Disclaimer of Warranties
This application is provided "as is" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. The application does not guarantee uninterrupted service, error-free operation, or any specific results from its use.
Limitation of Liability
The operator uses this application at their own risk. In no event shall Michael Fackerell be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of or inability to use the application, including but not limited to loss of data, loss of revenue, or account suspension on third-party platforms.
Termination
The operator may discontinue use of the application at any time. OAuth tokens may be revoked through the respective platform's account settings at any time.
Governing Law
These terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
Changes to Terms
We may update these Terms of Service at any time. Changes will be posted on this page with an updated effective date.
